How The Party Wall Act helps you and your neighbour
A Party Wall is the shared boundary structure between two properties. The Act applies in various scenarios, including:.
- In a terraced house, it is often both sides.
- In a semi-detached house it is usually the single dividing wall between houses.
- In a detached property, the Act can apply to extensions built by you, or your neighbour. It applies where any part of the extension or excavations will be within 3m of, and with foundations to a lower level than, the neighbour’s property.
- It can also apply where, for example, a basement is being built and any part is less than 6m from the neighbour’s property (and below their foundations).
The Party Wall etc. Act 1996 ensures that any construction work near a shared boundary structure is conducted safely and fairly, protecting both property owners.
- It assists building owners in conducting their proposed work and protects them from injunctions.
- It protects neighbours who may be affected by a neighbour’s works and assists them if any damage is done.
